Welcome to Heart of Balm (the "Website" or "Site"), operated by Heart of Balm ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our Website, including browsing, purchasing skincare products, and any related services (collectively, the "Services").

By accessing or using the Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website.

1. Use of the Website

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Website or purchase products. You agree to use the Website only for lawful purposes and in accordance with these Terms.

2. Products and Orders 

- All products are intended for personal, non-commercial use only. Resale without our written permission is prohibited. 

- Product descriptions, images, and claims are provided for informational purposes. We do not guarantee that results will be achieved, as individual skin results vary. 

- We reserve the right to modify, discontinue, or limit the availability of any product at any time without notice. 

- Orders are subject to acceptance. We may refuse or cancel any order (even after confirmation) for reasons including pricing errors, stock unavailability, suspected fraud, or non-compliance with these Terms. If we cancel an order after payment, we will refund you.

3. Pricing and Payment 

- All prices are in USD and exclude applicable taxes, shipping, and handling fees unless stated otherwise. 

- We reserve the right to correct any pricing errors. 

- Payment is due at the time of order. We accept major credit/debit cards and other methods displayed at checkout. 

- You authorize us (or our third-party payment processor) to charge the selected payment method.

4. Shipping and Delivery 

- Shipping times and costs are displayed at checkout and are estimates only. We are not responsible for delays caused by carriers, customs (for international orders), or events beyond our control. 

- Title and risk of loss pass to you upon delivery to the carrier. 

- You are responsible for providing a correct shipping address. We are not liable for lost or misdelivered packages due to incorrect information.

5. Returns, Refunds, and Exchanges 

- We offer a 30-day return policy for unused/unopened products in original packaging. Contact customer service at info@heartofbalm.com to initiate a return. 

- Return shipping costs are your responsibility unless the item is defective or we sent the wrong product. 

- Refunds are issued to the original payment method (less original shipping fees) after we receive and inspect the returned item. 

- No refunds or exchanges on final sale items, personalized products, or opened/used products unless defective. 

- Defective products must be reported within 14 days of receipt.

6. Disclaimer of Warranties

Products are sold "as is." We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. 

We do not warrant that our products will suit every skin type, treat or prevent any condition, or produce specific results. Patch testing is recommended. Discontinue use if irritation occurs and consult a physician.

7. Limitation of Liability 

To the fullest extent permitted by law, Heart of Balm, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website, products, or Services — even if advised of the possibility of such damages. 

Our total liability shall not exceed the amount you paid for the product(s) giving rise to the claim.

8. Intellectual Property 

All content on the Website (text, graphics, logos, images, product names) is owned by Heart of Balm or our licensors and protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works without our written permission.

9. User Content 

If you submit reviews, photos, comments, or other content ("User Content"), you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, display, reproduce, and distribute it. You represent that your User Content does not infringe any third-party rights.

10. Privacy  

Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

11. Governing Law and Disputes 

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Collin County, Texas. You agree to submit to the personal jurisdiction of such courts.

We may update these Terms at any time. The updated version will be posted here with a revised "Last Updated" date. Your continued use of the Website after changes constitutes acceptance of the revised Terms.
